Abstract
This contribution aims at proving the relevance of the protection of a claim by tort law mechanism. This kind of protection represents a novelty: it can serve in addition to the traditional protection in the insolvency proceedings.
The creditor, if he suffered damage, can claim compensation. Also this claim deserves a protection when the debtor acted against good morals or when he violated the so-called protective norm.
