The legislative draft on collective actions was presented by the Czech Ministry of Justice at the same time as the European Union is preparing a directive on representative actions, the aim of which is to introduce the institute of collective actions and to protect European consumers from damaging their rights and interests, with an undisguised ambition to become an effective means of avoiding infringements of Union law. The Czech draft also pursues a similar objective, but in many respects both models differ.
I believe that it is necessary to look for answers to the question of how the two regulations will be in proportion to each other and how the European directive touches the Czech proposal before adopting the Czech regulation.
