INTERNATIONAL JURISDICTION IN CASES OF NON- CONTRACTUAL LIABILITY ACCORDING TO BRUSEL IA REGULATION

Abstract

Determination of a court having jurisdiction in international matters relating to tort or delict is one of the most intriguing questions of international private law. The question of jurisdiction in civil and commercial matters is on the European level regulated by Brusel Ia Regulation.

This Regulation offers a claimant the opportunity to sue a person liable in tort in several courts; this includes the court of the defendant's domicile or the courts for the place where the harmful event occurred. The aim of this article is to introduce those various possibilities and relevant case law of the Court of Justice of the European Union.
