Hate speech on social networks and its sanctioning under the Criminal Code

Abstract

In the last ten years we have been witnessing a trend that more and more activities have been transferring from the real world to the virtual one. Among those, we can find several types of crimes, including hateful expressions towards others for their race, nationality, religion or any other similar characteristic, collectively referred to as 'hate speech'.

In her contribution, the author analyses the limits which criminal law imposes upon the freedom of speech and mentions several examples of crimes and the ways in which criminal sanctions may be inflicted upon their perpetrators. Using examples from abroad, she points out several challenges which the current criminal law legislation will have to face.

In the conclusion, the author offers several suggestions which should be considered by the law enforcement authorities.
