Abstract

The Czech Republic is a country with a long history of skiing, whose origins date back to the end of the 19th century. During the further development, the ski industry exspanded and skiing became a mass sport.

Due to the fact that skiing is significantly riskier compared to other sports, directly in proportion to the aforementioned development and the increasing number of skiers, there is also an increase in injuries. Although most injuries are caused by the skier himself, a significant part is due to other circumstances, including the fault of another skier.

Here, the courts have to assess and determine the responsibility of originators of damages , when assessing liability, they are based not only on generally binding standards, in particular the Civil Code, but also on specifically targeted support standards in the form of skier rules codified in the known Ski Decalogue, the FIS Rules of the Féderation Internationale de Ski. These rules were being prepared for many years before they came to their present form, which is designed to increase safety in the pursuit of ski sport.

The contribution provides an unpublished insight into the process of their creation and the birth of the current wording, thus illustrating their importance.
