Detection of the child's opinion in court proceedings - interdisciplinary study

Abstract

With the problem of discovery and the importance of child 's opinion in judicial proceedings deals a lot of legal, psychological or pedagogical professional works. This problem is also every day practically solved by judges, collision guardians, attorneys, experts, and, last but not least, by parents and their children, especially in court proceedings concerned with custody of minors.

The question of the participation of minors in court proceedings concerning them has been given increasing attention in recent years not only in Czech Republic, but also internationally. The necessity of protecting the right of the child to be heard by the court is very often highlighted at the constitutional and international level.

At the same time, each custody proceeding should be primarily aimed at the best interests of the child. In this legal area, we can meet many indefinite legal terms.

In interpretation of these terms, there could be very helpful knowledges and experiences beyond the law. The aim of this text is to combine knowledges from different disciplines in order to provide a more comprehensive view of the issue.
