The aim of the article is to give a basic overview of the issue as an introduction to the special legal volume of the journal. At the same time, the legislation on tourism in the Czech Republic is analyzed overall.
Legal regulation of tourism is markedly complicated, in addition it is currently undergoing a fundamental transformation, and this instability is often referred to as one of the key problem of the tourism in the Czech Republic. The article is gradually passing through the various elements of tourism regulation, their legal status in 2018 and prospects for the future.
Tourism legislation is highly fragmented, it interferes mainly into commercial, civil and administration law, whereas partly stems from the European Union law. In 2018, major amendments were made to the new directive on package tours.
The discussions about the Act on support of tourism development, work on which has been lasting for several years now, have not fallen silent yet. In 2018, the destination management certification was run instead of the Act on support of tourism development.
There are present attempts to connect the fees related to tourism in the Act on local fees or adopt a completely new act on heritage care. In summary, in 2018, tourism legislation has undergone a major transformation and many other changes are being prepared.
