Abstract
Compensatory planting and compensatory fee based on Act No. 114/1992 allows the remedy of the environmental damage caused by the felling of trees in Czech republic. This article briefly illustrates the different legal regimes of tree felling and subsequently describes the existing legislation on compensatory planting and compensatory fee, including their application in practice.
It focuses primarily on the weaknesses of this institute, consisting of inappropriate legal regulation. The article presents several fundamental problems, making the existing legislation almost inoperative.
At the end of the article there are some suggestions for improving the legal regulation, including comparison with the more advanced legislation on compensatory planting in Slovakia.
