Models of vaccine injury compensation in selected countries and their implication into the Czech legislation

Abstract

Due to the framework of mandatory immunization in the Czech Republic, one may frequently hear calls for introduction of a compensation system which could enable to indemnify possible vaccine injury. If there is no proof that the vaccine was faulty or the physician acts in non-lege artis way, there is no subject specified to compensate the patient in any way as per our legal system.

The proposed law and the corresponding decree implementing it aims to provide legal certainty and establish responsibility of the state in the cases where health damage is a consequence of a vaccination ordered by state.
