Trust in Continental Law - A sketch on the edge of a myth based on the Czech Fiducia

Abstract

Czech trust is not English trust. It is a transplant from the fiducie of the Civil Code of Québec.

The main problem is that the property put in the fiducie doesn't have owner. The resolution is the correction of the Czech fiducie and as a legal person.
