Abstract
This chapter deals with the pledge and transer of title as a security of obligation. The main part is focused on the dundamental chararacteristics of each security instrument of obligation.
The principles of subsidiarity and accesority is researched in comparison of both instruments. From clearly positivistical point of wiew the Civil Code, The Financial security Act and The Land Register Act are mentioned.
Also the possibility of using the securing fund with connotations of acwuisition from non owner is analyzed.The chapter is closed by analysis of simultaneously coexistence of the pledge and transfer of title as the security of obligation.
