Threats Related to the Phenomenon of Foreign Terrorist Fighters and the Possibilities of their Elimination by Means of Criminal Law
Abstrakt
The article points to the phenomenon of foreign terrorist fighters, representing one of the current threats of international terrorism. The participation of such persons in the terrorist attacks already carried out in Europe, as well as their expected return to Europe in the context of the current developments in Syria, have led to the adoption of measures aimed at suppression of this phenomenon.
Concurrently, an important role is played by the measures developed for the purpose of detection and disruption of the pathways relating to the terrorist activities and other activities related to recruitment or training for terrorism. The criminal-law standpoint is crucial requirement criminalization such proceedings threatening society.
Therefore, the article also examines the possibilities to apply a criminal liability of a "traveler for terrorist purposes" pursuant to the current Czech criminal code in comparison to the requirements of the adopted Directive on combating terrorism.
