HUMAN RIGHTS AND THE ENVIRONMENT

Abstract

Human rights or fundamental rights and freedoms are the most important subjective rights, that are constitutionally guaranteed. The scope of these fundamental rights and freedoms is not closed, nor is it given by the Charter or by positive law at all.

Further developments include the issue of collective rights and, among other things, the right to a favourable environment (within the framework of the so-called new rights developed since the 1970s). This work deals with the issue of basic human rights, from the perspective of three-generation and four-generation concept and the right to a favourable environment and the practice of its application in the legislation of the Czech Republic.

It must be stated that the current concept of new rights, in particular the right to a favourable environment, is not fully sufficient.
