Legal Perspective on Cryptoactives

Abstract

The paper examines current development in the law terminology regarding the crypto-assets and so-called cryptocurrencies. In the first part it analyses the term crypto-asset and cryptocurrency and points out the main differences between the two.

Further on it compares the term cryptocurrency from the perspective of economic theory of money and legal institute of currency. It concludes that crypto-assets nor cryptocurrencies are currencies from the perspective of current legislation, although they can fulfil some of the functions of money.

The second part examines the difference between terms virtual currency, digital currency and cryptocurrency. At last it describes the meaning of the term payment token, that is closely related to the topic studied.
