The Term "International Cooperation" in Regard to the Admission of Refugees from the Perspective of International Law
Abstrakt
The paper deals with the term "international cooperation" and similar terms such as solidarity, responsibility- and burden-sharing in refugee law. The aim of the paper is to analyze how states perceived the term "international cooperation" and similar terms when the Convention Relating to the Status of Refugees from 1951 was adopted as well as they perceive these terms today in the Global Compact on Refugees from 2018.
The author comes to the conclusion that states did not intend to establish certain legal obligations by reference to international cooperation in the Preamble of the Convention and that the Global Compact on Refugees shows they do not want to change this situation. While the principle of international cooperation and solidarity is perceived as necessary, as it is recognized that the host states need the assistance of the international community, states do not accept any legal obligations and their assistance thus remains voluntary.
