Strengthening the principle of honesty through Corporate Social Responsibility

Abstract

In the current legislation, the principle of honesty is one of the basic principles of private law. Unlike the previous legislation, it is explicit.

By honest behavior we mean a certain - mandatory - standard of conduct, representing behavior that is in accordance with both legal and moral standards, so it is everyone's duty to act to protect the rights and legitimate interests of the other, and the actor should be convinced that he acts honestly and politely. Companies are increasingly committed to the principle of honesty for several reasons.

On the one hand, it seeks to eliminate any liability of the corporation for its dishonest behavior in general; Companies, in addition to statutory obligations, voluntarily and publicly adhere to a certain higher standard of behavior. Voluntary commitments of a certain type can be described as characteristic elements of the CSR concept.
