Abstrakt
The article deals with the determination of a person's legal status, first in general and then in the historical context of the Czech Republic. However, the focus of the paper is the analysis of the issue of surrogate motherhood from the perspective of applicable law, case law and doctrine.
The article also describes the practice of surrogate motherhood in the Czech Republic in the gray zone of law and its legal consequences. Attention is also paid to surrogate motherhood with a foreign element as well as criminal aspects.
The authors conclude that surrogate motherhood is widely practiced in the Czech Republic, and although at least for this reason it would be appropriate to enact it in a particular act, the adoption of such legislation cannot be expected in the near future.
