Abstract
The article examines the legal regulation of professional confidentiality obligations under the Banking Act. In relation to the taking of evidence by questioning a witness in civil proceedings and criminal proceedings, attention is paid to the possibility to the person concerned of thir duty.
The legal regulation of conditions and reasons for exemption from confidentiality is analyzed. The article raises some questions of interpretation that can be discussed.
