The author analysis the system of liability for damage caused by a defective product as established in sec. 2939 et seq. of the Czech Civil Code. He focuses on the approach of the Czech legislator to product safety and the legitimate expectation of such safety on the part of users.
He comes to the conclusion that the Czech transposition of European Directive is not precise enough, especially as regards the notion of damage and the criterion of legitimate expectation which it considers from the manufacture's perspective instead of the user's.
