Obligation of Data Retention in the case law of the Court of Justice of the EU and the Constitutional Court of the Czech Republic

Abstract

The obligation to retain traffic and location data is being examined for the fourth time by the Court of Justice of the EU. At the request of the French, United Kingdom and Belgian courts, it assesses whether the national legislation, which imposes an obligation to retain the data of all participants, is contrary to European Union law.
