Abstract
This article analyzes the issue of ownership of the set-aside assets in a trust which is "neither owned by the trustee, nor owned by the founder, nor owned by the person to be transferred from the trust" and aims to reach a solution based on this comparative analysis, corresponded to the Czech concept of ownership and at the same time better reflected the context of the legal order.
