Abstract

The article deals with the analysis of the default judgment, its comparison and proposals for future legislation. The judgment by default is de lege lata governed only by the defendant's default at the first hearing in the case.

Given the substance of the default judgment, this is a legally insufficient solution. De lege ferenda it is eventual for the Czech civil procedure to seek inspiration in the German, Slovak or Austrian legislation.

In conclusion, the author presents his results from the research carried out in the given topic, while proposing a specific concept of the future legislation of a default judgment.
