Defining compensation for the establishment of easements in the heating industry

Abstract

Energy network operators are legally authorized to operate their networks on other owners' property, as it is in the public interest that energy be reliably delivered to customers. However, this implies a restriction on the ownership rights of the owners of the encumbered real estate.

This paper focuses on how to properly determine compensation for the establishment of easement in the heating industry; it is analysed whether the owner should be compensated for restrictions in the form of the existence of a protective zone, or who should be a passively legitimate entity.
