The use of the so-called "anti-terrorist" agent and other criminal means in the fight against terrorism

Abstract

This paper focuses on current news of the anti-terrorism legislation in the Czech Republic and on the issue of the use of the so-called "anti-terrorism" agent according to the § 158e of the Czech Criminal Procedure Code. The author mentions the latest cases of terrorist attacks and subsequently proceeds to the difficult definition of the term "terrorism".

Attention is then paid to the two significant changes of criminal law that changed the possibilities in combating against the phenomenon of terrorism. The core of this paper is the problematics of the use of an agent in uncovering terrorist offenses.

Author is also giving several de lege ferenda suggestions for possible better regulation of this matter. These proposals result primarily from the critical comparison of Czech and Slovak legislation.
