20 - Codification of the Rules od International Responsibility and their (Non)-Application by the European Courts

Abstract

In contemporary international law, where most rules appear in international treaties or other written sources of law, there is one important corpus of rules that remains in unwritten: customary form. This is the law of international responsibility, which has not been systematized for a long time.

In a sense, the system of the law of international responsibility came into existence thanks to its codification, in particular the one achieved by the International Law Commission of the United Nations (ILC).
