Law of Unfair Competition

Abstract

Author focuses on the law of unfair competition in the Czech Republic and examine the same to the widest extent, that is, focus on the areas covered not only by the Czech Civil Code but also by public laws of the Czech Republic, particularly by the Consumer Protection Act implementing the Unfair Commercial Practices Directive. The aim is to generalise the existing legislation, recent case-law and doctrinal approaches and present a common understanding of unfair competition as a separate category of torts.

Special attention is, therefore, paid to the basic concepts of assessing the correctness of competitive conduct: the general clause and average consumer test.
