On issues of subsidiarity of criminal and administrative repression

Abstract

The paper deals with selected aspects of subsidiarity of public repression. One of the expressions of the subsidiarity of criminal repression is the non-exercise of the powers of law enforcement authorities in cases where the exercise of the powers of administrative authorities is sufficient.

The relationship between criminal and administrative punishment today is complicated by a different conception of a crime and an administrative offense. Criminal and administrative punishment can be preferentially replaced by other means of power of the public administration.
