Abstract
The legal analysis defines and justifies the basic principles for the allocation of scarce resources related to the provision of intensive care in a situation when the care cannot be provided to all patients who would benefit from it. It deals with several problems: modification of the standard of care, refusal of intensive care provision to a patient, termination of intensive care, and transport of a patient to another health facility.
There are also defined principles for the process of clinical decision making regarding the admission of a patient to intensive care or its termination. The analysis is sufficiently comprehensible for non-lawyers while it provides exhaustive legal justification for the defined principles.
