SOE - State Owned Enterprises as an administrative body

Abstract

Whatever the legal form of SOE - typically it will be a joint stock company - it will act towards the third persons as a separate legal entity, allowing it to enter into private and public law legal retionships. The aim of the chapter is to explain under what conditions it is possible that a legal entity of private law, ie a typical business corporation, can decide and act as an administrative body.

For this reason, attention has been paid to the question when we are dealing with private legal act (conduct) and, on the contrary, when we are dealing with public decision-making, which is not only realized by administrative bodies, but also by juristic persons which are then considered to be 'administrative bodies'.
