Presumption of Death. Commentary on Section 71 to 76 of the Civil Code

Abstract

The paper contains a systematic interpretation of the legal institute of the presumption of death. Attention is paid to both presumptions of death, highlighting the key differences between them.

Furthermore, the prerequisites of a declaration of death by a court on the basis of these presumptions and the issue of periods of time that must first elapse before a declaration of death are systematically explained.
