Regulation of short-term rental services in the light of the caselaw of the CJEU

Abstract

The sharing economy and the smart technologies bring a number of benefits to consumers, such as lower prices, flexibility and a wider choice between various services. However, they can also bring negative externalities.

Can they therefore be regulated effectively by the Member States without infringing the right of establishment or other freedoms of the internal market? This paper will address the issue of the EU Services Directive in relation to the activities of the sharing economy carried out through digital platforms in the light of the three recent judgments of the Court of Justice of the EU in the cases of Cali Appartments SCI and HX, Airbnb Ireland and Uber France.
