Abstract

The chapter offers an expert scientific commentary on the prohibition of forced self-incrimination in selected case law of European Court of Human Rights.The European Court of Human Rights initially examined, on the basis of specific circumstances, whether, in the final analysis, the proceedings did not infringe the very essence of the right not to contribute to one's own accusation. Later, the case-law clarified that, in that examination, account must be taken, in particular, of the individual specifics of a particular case.
