Interventions of Supervisory Authority into Autonomy of Will in the Field of Insurance

Abstract

The authors are dealing with the interventions of the Czech National Bank (CNB) in the field of insurance with using the supervisory benchmarks. The authors argue that supervisory benchmarks might be used by the CNB for setting up the expectations of insurance companies from the CNB for the future.

However, it should not use them to assess the performance of insurance undertakings in the past before issuing a given benchmark.
