The Possibilities of Artificial Intelligence in the Assessment of Breach of Duty in Medical Negligence Cases

Abstract

The possibilities of the use of artificial intelligence in the judiciary are an ever more discussed topic. Therefore, there might arise the question of the use of artificial intelligence for the assessment of compliance with the professional standards (the so-called lege artis standard) in the provision of health services.

The article first analyses the particular aspects of these standards. Then, it identifies problems that an artificial intelligence system would have to overcome to be able to assess the provision of health services reliably.

Taking into account the necessity to assess complexly a lot of aspects, many of which are not available in scientific databases, it seems to be likely that similar tasks would only be possible for a strong artificial intelligence comparable to human reasoning.
