Abstract

This chapter deals with comparison of public regulation of insurance intermediaries' undertaking in the framework of insurance distribution with private regulation of mandate-type contracts under the Civil Code. Also the consequences in the field of AML and personal data protection are reflected.

The author compares the particular mandate-type contracts, i.e. mandate, brokerage, undisclosed mandate and commercial agency contract for the purpose of suitability in insurance intermediation. The author also makes specific recommendations on how to proceed in contractual relations of this type.
