The Nuremberg Principles and Their Current Impacts

Abstract

The Nuremberg principles are a generalization of the legal basis that the individual international criminal responsibility was built upon. Aspiration of the principles was to express customary international law and despite decades that passed since the principles were adopted, their heritage is still clearly visible in the development of international criminal law.

Case-law of the ad hoc international criminal tribunals and of the ICC have sometimes diverged from the principles and sometimes it elaborated upon them. The purpose of this article is to comment on several interesting legal developments based upon the principles.
