Liability insurance for harm caused by the operation of autonomous vehicles from the theoretical point of view
Abstract
In this article, the authors intend to deal with individual theoretical aspects of liability insurance for harm caused by the operation of autonomous vehicles. At the beginning, the position of a legal theorist in relation to such a new topic will be defined.
Subsequently, the authors will present specific aspects of the topic that future practice will have to deal with and which include e.g. the need to resolve the concurrence of operation of fully autonomous, partly autonomous and non-autonomous vehicles, the issue of randomness and insurance interest, the definition of the policyholder or insured person, the issue of setting limits of insurance benefits, effects on pricing of insurance products and impacts on settlement of insured events
