Agreement for the termination of Investment Treaties between the EU Member: Problem solved finally?

Abstract

In May 2020, 23 Member States of the European Union signed the Agreement for the termination of Bilateral Investment Treaties between the Member States of the European Union. This agreement enters into force on 29 August 2020.

However, it does not mean the end of the story of lengthy disputed intra-EU bilateral investment treaties ("intra-EU BITs"). The agreement was not signed by all EU Member States.

The situation is further complicated by the United Kingdom which rejected to join under the Brexit circumstances. However, the crucial question concerns safeguards for the protection of European investors in a Single market in the shadow of doubts over the rule of law in several Member States.
