On review systems in civil proceedings

Publication at Faculty of Law |
2020

Abstract

This paper focuses on review systems as a more general definition of the principles governing review of judicial decision. In the doctrine of civil procedure, there are three corrective systems, namely the principle of appeal, cassation principle, and revision.

Their distinction is important both in terms of the rights and duties of the court for the correction of errors and in terms of the procedural status of the appellants. The aim of the paper is to analyse the review systems and also to consider the developmental tendencies in the current modern civil procedure in the field of review proceedings.
