The rights to environmental protection are based on the third and fourth generation of human rights, respectively. It is part of the so-called new human rights.
In the Czech Republic, the "favorable environment" is guaranteed by valid legislation - laws, the Constitution, the Charter of Fundamental Human Rights and Freedoms and international treaties and agreements that are superior to them. Nevertheless, environmental protection still remains component (divided into individual components that are difficult to interconnect - air, waste, agricultural land, etc.) and completely dependent ownership and its inviolability guaranteed by the Constitution.
However, the question is the sufficiency of the current rights to the environmental protection. This is exactly what this article will deal with, which is based on the assumption of their inadequacy, shows specific areas and some proposals for change.
