On the Crimes of Endangering a Child's Care and Seduction to Sexual Intercourse and Their Relationship

Abstract

The chapter is dedicated to two crimes against family and children - endangering a child's care under Section 201 of the Criminal Code and seduction to sexual intercourse under Section 202 of the Criminal Code. The author points out the specific characteristics of this type of criminal activity on the part of the perpetrator and the victim and draws attention to the deficiencies of the current legal regulation and the application practice.

With the help of the relevant case law of the Supreme Court of the Czech Republic, she addresses, in particular, the permissibility of the concurrence of these offences, criticises the construction of concurrence based on the understanding of seduction to sexual intercourse under Section 202(1) of the Criminal Code as a part of broader imperilling conduct penalised as endangering a child's care under Section 201(1) of the Criminal Code and proposes a complete revision of the legal regulation of the penalisation of the vice criminality committed against children to the legislator.
