Current Issues of Czech Legal Regulation of Tourism in 2019

Abstract

The aim of the article is to give a basic overview of the field as an introduction to a special issue of the journal dedicated to law. A similar approach was taken also in the issues 1/2018 and 1/2019 of this journal.

Legal regulation of tourism is particularly complicated, in addition it is currently undergoing a fundamental transformation, and this instability is often mentioned as one of the key problems of the tourism in the Czech Republic. There is no code governing tourism as a whole.

The regulation of tourism overlaps mainly with commercial, civil and administrative law and it is significantly influenced by the European Union law. The article deals with various elements of tourism regulation, their legal status in 2019 and prospects for the future.

The issue of minority monuments is covered more extensively as the author focused on this field throughout 2019. A considerable part of cultural monuments is connected with minorities, which often makes their use for tourism difficult.

The main trend of the tourism legislation is its dynamism and modernity. The extent of changes is unusual in law and there are also many peculiar specific aspects.

In summary, tourism legislation has changed last year 2019 - some issues were legislatively solved (i.e. amendment of the act on local fees) and some will be dealt with next year (i.e. issues regarding sharing economy in the field of accommodation). However, the development is often unpredictable, as shown by the issue of minority monuments.
