Public Interest and Strict Liability for Abnormally Dangerous Activities

Abstract

The contribution analyses strict liability with focus on the issue whether the current regulation of cases of so-called strict liability and in particular with regard to abnormally dangerous operations contain or reflect public interest. It further focuses on identification and categorisation of the public interest which regulates strict liability, i.e. the identification of particular characters of strict liability, and the cases of justification of the liable party.

Thus, the study provides for a definition, what is the contain of public interest in case of strict liability for abnormally dangerous operation, who is the interest holder of the public interest and who establishes the public interest within the system of strict liability for abnormally dangerous operations.
