Foreign approaches to the principle of subsidiarity of criminal repression

Abstract

The postulate that criminal law acts only as a means of ultima ratio to protect individual and general interests is recognized in many states. Based on the comparison (Slovakia, Germany, England), it was pointed out that when considering (de) criminalization, this postulate can take various forms.
