Confiscation as a Result of Sanctions from 1918 to 1950

Abstract

The article deals with confiscations in the period from 1918 to 1938, in the period of the first Czechoslovak Republic. The aim of the study is to conceptualize the issue of confiscations in a defined period.

The basic starting point is the concept of confiscation in the narrower sense, as the deprivation of property rights linked to previous legal proceedings (not to the missing compensation as a defining feature), to the associated liability element and the subsequent sanction. The study deals with the valid legal regulation of confiscation in a defined period and the terminological concept of the institute of confiscation.

The paper also includes application practice, which is discussed through some selected cases that demonstrate the concept of confiscation on a practical level.
