Representation. Specifics and context

Abstract

The legal monograph entitled Representation, with the subtitle of Specifics and Context, focuses on the classical civilian theme, which is developed on several levels. The text is based on the premise that readers have a certain level of knowledge of the topic of representation, and is thus intended especially for those lawyers who are interested in gaining a deeper insight into the specific issues of representation, without losing the broader context.

The topic is treated according to the duality of civil procedural law (or rather civil procedure) and substantive law and according to the dichotomy of view to the past and future. The set topic is analyzed by authors and young legal scientists with an emphasis on the depth of knowledge of the problem, where they focus on the specifics of individual aspects of representation, which they examine not only in a narrow profiling perspective.

The chapters on representation in collective actions, issues of electronic power of attorney or the possibility of (future) use of artificial intelligence in representation are particularly topical. The monograph also deals with a number of traditional processualist and civilian problems, which it tries to solve functionally, e.g. legal admission, substitution in civil proceedings, independence of a lawyer as a party representative or a minor's representation.

Some issues are deeper analyzed in the Czech conditions and in the given extent for the first time, they are to serve as a starting point for further debates on the constantly current topic of representation. The authors try to thematize this topic in new and traditional contexts and with emphasis on some current issues.
