Glossary II: Compensation for damage under the Crisis Act from a private law point of view - damage as damage to property

Abstract

In Glossary I, we considered in which cases the state's liability for damage arises pursuant to Act No. 240/2000 Coll., On Crisis Management and on Amendments to Certain Acts (hereinafter the "Crisis Act") and whether the existence of wromgfulness on the part of the responsible party is necessary.. We now turn to the question of what can be considered as damage (ie damage to property) compensable under the provisions of § 36 paragraph 1 of the Crisis Act, which stipulates that "The state is obliged to compensate damage caused to legal and natural persons in causal connection with crisis measures . "
