Personal Protective Measures as a New Feature of the Czech Labour Law

Abstract

This article considers international, union and Czech national law that regulates personal protective instruments. Special attention is given to face masks as set forth by emergency decisions issued by the Czech Government during its campaign against the COVID-19 virus.

The government insists on universal duty to wear face masks despite contradictory laws and two court decisions that abrogated respective governmental decisions. Face masks can have certain role in the state contingency policy against the virus, but its efficiency seems to be overestimated.

The fundamental question raised by this article is, what legal status can be assigned to the face masks?
