This book is the first comprehensive monography on the legal aspects of surrogacy in the Czech Republic and related issues. Surrogacy is an institution that is not legally regulated in the Czech Republic, but only tolerated.
In the book, the author views this institute from various angles. The civil law approach is crucial, but it does not neglect the constitutional and possible criminal law context of surrogacy.
The text summarizes important decisions of Czech and European courts on the issues of artificial insemination, adoption by same-sex couples and, above all, on the interpretation of the term "best interests of the child". At the end of the book, the author clearly summarizes the legislation and the factual situation in selected countries of the world and adds his considerations de lege ferenda.
He approaches surrogacy with the humility required by the subject. The interpretation is consistently built around the concept of "the best interests of the child", the fulfillment of which should be the basis of all considerations and actions related to surrogacy, whether in the field of law, sociology or ethics.
