Abstract
The legal institution of testament raises a fundamental question for legislators all around the world: "What a valid testament should look like?" In this paper, we will specifically focus on the issue of formal validity of testaments. We will not examine how the legislators dealt with this issue in the Czech legal system, but in the legislation of other European states.
In the final part of this paper we will look beyond the borders of our continent, specifically we will focus on the legal regulation in Québec.
